The family team at Berry Smith is supporting Family Mediation Week 2025, which takes place between Monday, 27th and Friday, 31st January, with the aim of raising awareness of the benefits of mediation within the family justice system.
In our experience at Berry Smith, many families who come to us for advice or mediation services do not fully understand the role and benefits of family mediation in helping them discuss and make decisions about their family and future.
One common misconception we frequently see is that mediation is a form of marriage or family counselling; this is not the case.
Family mediation is a voluntary process that provides separating couples with a forum and support to discuss arrangements and make decisions in a supportive and constructive environment.
Here at Berry Smith Solicitors, we understand that family disputes can be emotionally draining and stressful, and that traditional negotiation through solicitors can feel unwieldy, distant, and confrontational. Mediation offers a practical alternative by providing a safe, confidential environment where all involved can express their concerns and work towards mutually agreeable solutions.
Our mediators, Katie McColgan and Benjamin Delve, are both practising family solicitors and bring extensive experience and empathy to each session. They can help you address a wide range of issues, including child arrangements, financial settlements, and property disputes. Their focus is on open communication and collaboration, enabling you to retain control over the outcome.
Mediators have specialist training and use strategies not typically adopted by solicitors, including interest-based negotiation (focusing on underlying needs rather than fixed positions) and reframing (shifting negative language into constructive dialogue). These techniques help families move past conflict and find solutions tailored to their unique situation.
It’s not just about finding solutions; it’s about finding the right solutions for you and your family.
If you would like to discuss whether mediation or any other alternative dispute resolution should be considered in your specific case, or you need advice on any other family law matter, please do not hesitate to contact the family team by email at family@berrysmith.com or by telephone on either 02920 345511 or 01656 645525.
